Terms and Conditions

The Melbourne Property Tour Package (“Tour Package”) is offered subject to the terms and conditions set out below (“Terms and Conditions”). The promoter of the Tour Package is Resimax Group Pty Ltd ABN 80 164 428 942 (“Resimax Group”).

1. Who is eligible?

(a) Entry is available to any person aged 25 years or older who is eligible for a VIP Membership and a travel visa (“Member” and “You”).

(b) Proof of age and travel visa may be required to claim the Tour Package.

2. How to Register

(a) The Member must attend a Resimax Group Property Power event held periodically in cities across Asia (“Event”) and complete the registration form for the Tour Package available at the Event.

(b) Resimax Group, in its sole discretion, may determine whether the Member has validly completed the registration.

(c) Resimax Group, in its sole discretion, may determine if a Member who has completed the registration and attended the Event is entitled to receive the Tour Package.

(d) Upon registration to attend a Melbourne Property Tour, the Member is required to lodge a refundable bond using a credit card. The bond is refundable to the Member within 14 days of the end of the tour event.

(e) The Member is referred to paragraphs 8 and 9 of the VIP Membership Terms & Conditions for further information about Melbourne Property Tours.

3. The Tour Package

(a) The Tour Package consist of, and is only redeemable, for the following:

• Return flights from departure city to Melbourne, for one person per entry (on an airline to be selected by Resimax Group).

• Return transfer to and from the airport to the hotel in Melbourne

• Accommodation (except in-room charges) in Melbourne (hotel to be selected by Resimax Group) in a Standard Room with breakfast.

• Bus transfers during the days and return to the hotel each evening

• Lunch included on the tour days

• Admission to organised functions – selected by Resimax Group and subject to variation.

(b) The Member is liable for all other costs incidental to the Tour Package such as insurance, visas and transport to the departure airport at the commencement of the tour.

(c) This is a single-use Tour Package. Any un-used portion of the Tour Package is forfeited and is not redeemable for cash or other forms of credit.

(d) The eligible Member may add services or stay additional nights however the Member is responsible for any additional costs.

(e) The Tour Package is not transferable, exchangeable, replaceable or refundable for cash or credit and can only be used as specified.

4. Notification and claiming the Tour Package

(a) The eligible Member will be notified by Resimax Group (at Resimax Group’s sole discretion) using the contact details provided by the Member.

(b) The eligible Member has 48 hours from the time and date of the notification being sent to respond, provide proof of eligibility and claim the Tour Package. The Tour Package will not be reinstated, refunded or replaced, even in the event that the reservation is cancelled or changed.

(c) If the Tour Package is not claimed by the eligible Member within the 48 hour time frame, Resimax Group may withdraw the offer to the Member.

(d) All bookings are subject to availability at the time of booking and subject to the respective providers’ terms and conditions. Changes or cancellation may incur charges from the Airline, Hotel or other providers. The eligible Member is responsible to pay any such charges incurred as a result of the Member’s cancellation or request for any change.

(e) The Member, to the fullest extent permitted by applicable laws, indemnifies Resimax Group, its subsidiaries, related entities and each of its officers, directors, employees and agents against any claims, losses, costs, damages, liabilities and expenses (including reasonable legal fees) arising from any claims by any third party, in connection with the Member’s breach of these Terms and Conditions or the terms and conditions of a provider referred to in 4(d).

5. General

(a) Resimax Group reserves the right to change these terms and conditions without notice from time to time.

(c) Members must comply with all the normal terms and conditions connected with the booking.

(d) Except for any liability that cannot by law be excluded, Resimax Group (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

i. the Tour Package;
ii. any technical difficulties or equipment malfunction (whether or not under Resimax Group’s control);
iii. any theft, unauthorised access or third party interference;
iv. any registration form that is late, lost, altered, damaged or misdirected (whether or not after its receipt by Resimax Group) due to any reason beyond the reasonable control of Resimax Group;
v. any variation in Tour Package value to that stated in these Terms and Conditions;
vi. any tax liability incurred by a Member; or
vii. use of the Tour Package.

(e) Resimax Group collects Members’ personal information in order to conduct the Tour Package. If the information requested is not provided, the Member may not be able to participate in the Tour Package. Resimax Group will not disclose this information to anyone other than contractors who provide services for the purposes of conducting the Tour Package unless compelled or permitted by law. Resimax Group agrees to use any Personal Information collected in accordance with the Resimax Group Privacy Policy A request to access, update or correct any information should be directed to the Privacy Officer of Resimax Group. . 6. Photos and marketing

You consent to Resimax Group using images of you taken during the tour for advertising and promotional purposes in any medium it chooses. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

7. Governing Law

These terms and conditions are governed by the laws of Victoria. Any person relying on, or seeking to enforce, these terms and conditions submits to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.

8. Severability

If any provision of these terms and conditions is unenforceable or invalid, it must be read down so as to be enforceable and valid. If this is not possible, the provision may be severed without affecting the enforceability or validity of the remaining provisions

9. Waiver

Any failure or delay by Resimax Group in exercising its rights under these terms and conditions does not constitute a waiver. Any wavier by Resimax Group must be in writing and signed by an authorised officer of Resimax Group.
