Terms and Conditions

Introduction

Resimax Group Investor’s philosophy is to create wealth through a mutual sharing of knowledge, followed by action, in property investing. As a VIP Member, you are invited to attend events where this knowledge is presented by industry experts and opportunities for action are offered exclusively.
To facilitate both education and action, VIP Membership includes participation in Resimax Group Investor’s Melbourne Property Tours.

The following Terms and Conditions govern the Resimax Group Investor VIP Membership program.

1. Definitions

In the Terms and Conditions, these words have the following meanings:

Benefit means any benefit, privilege, promotion or reward under the VIP Membership

Commencement Date means the date on which a VIP Membership commences

Event means a seminar, presentation, tour or other function organised by Resimax Group Investor to promote knowledge and action in property investing

Guest means an invitee of a Member who accepts an invitation to an Event

Melbourne Property Tour means one type of Event organised by Resimax Group Investor

Member means a member of the VIP Membership program

Membership means VIP Membership

Membership Point means a redeemable point earned by a Member

Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth) and includes similarly defined personal information in any other jurisdiction

Property Power means one type of Event organised by Resimax Group Investor

Related Body Corporate has the meaning given in the Corporations Act 2001 (Cth)

Resimax Group means Resimax Group Pty Ltd (ACN 164 428 942) and any Related Body Corporate.

Resimax Group Investor means a business unit of Resimax Group and includes Events, products or services conducted or offered by Resimax Group.

Resimax Group Privacy Policy means the privacy policy adopted by Resimax Group from time to time. A copy is available at here.

VIP Membership means the Resimax Group Investor VIP Membership program, the terms and conditions of which are set out in this document.

2. Member Profile

To be able to apply for VIP Membership a person must:

• be over the age of 25 years;
• be in stable employment or have a source of capital income for at least the past six months;
• be in possession of a passport with a minimum of 6 months validity;
• be in possession of a credit card in their own name;
• be able to produce photo ID in the form of a Drivers Licence, Passport or Government ID Card.
• agree that their attendance at VIP Membership events is to acquire knowledge about property investing.

3. Family Membership

• Membership is personal to the Member and may not be transferred.
• Membership of a family unit (Member, spouse and children) is deemed to be one Membership.
• Adult children of the family unit (those over 25 years) must apply separately for a Membership.

4. Cost of Membership

• The cost of Membership is a once-only AUD 5,995.
• Membership applies to one person only, except for family units (above).
• Resimax Group Investor reserves the right to offer payment terms for the cost of Membership and may vary, or reduce, the cost at its discretion.

5. Term and Renewal

• Membership is for a term of one (1) year from the date of acceptance by Resimax Group Investor.
• Membership is automatically renewed annually at the discretion of Resimax Group Investor.
• No payment is required on renewal.
• Membership points accrued by the Member are permanent and not subject to renewal or forfeiture except as described below.
• The Member may cancel their membership at any time by providing notice to Resimax Group Investor in writing.
• Where the Member does not engage in any activity to earn points over an 18-month period, the Member’s points will expire. Activities to earn points are as described in paragraph 6, below.

6. Membership Points

Membership provides the Member with the opportunity to acquire points (measured in Australian dollars, AUD). Points are awarded for a variety of activities, which may be added to or changed over time.

At a minimum, Membership Points may be acquired by the Member for the following:

• On acceptance of Membership application;
• By attendance at Property Power events by the Member;
• By inviting guests to Property Power events where the invited person registers and attends the event and confirms the name of the person who invited them;
• Other activities as advised to the Member at the discretion of Resimax Group Investor.

The number of points for each activity is determined by Resimax Group Investor and may be subject to revision from time to time. However, once a Member has accrued points, the value of such points to the Member will not be changed, even if the value of activity points is revised in the future.

7. Conversion of Membership Points

Membership Points may be converted into Australian Dollars at the point where the Member purchases a Resimax Group property and makes the final payment.
At conversion the points, in dollars, may be applied against the purchase price of the property and the purchase price reduced by the amount of points (in dollars).
Membership Points may only be applied against the purchase of a property after the purchaser becomes a VIP Member and does not apply to any previous purchase of a property.

8. Melbourne Property Tour

• VIP Membership entitles the Member to attend one free Melbourne Property Tour.
• VIP Family Membership entitles a single person within the family unit to attend one free Melbourne Property Tour.
• The Melbourne Property Tour is offered free-of-charge to the Member with Resimax Group Investor paying the cost of airfare and hotel accommodation for the Member.
• If the Member wishes to attend additional Melbourne Property Tours at any future time, they will be charged, at cost.

9. Melbourne Property Tour Bond

• Attendance at a Melbourne Property Tour requires the Member to lodge a refundable Bond of AUD $1000 with Resimax Group Investor via a credit card.
• Upon application to attend a Melbourne Property Tour, the Member is required to provide credit card details for the purpose of lodging the refundable Bond.
• The Bond is refundable in full after the Member has attended the Melbourne Property Tour and returned home. If the Member fails to attend the Melbourne Property Tour, then the Bond will be forfeited to Resimax Group Investor.
• Melbourne Property Tour participation is subject to a separate set of Terms and Conditions which are provided to the Member upon registration to attend.

10. Membership Card

• Upon acceptance of a Member’s application, the Member is provided with a VIP Membership Card. The card contains a barcode which records the accumulated points that the Member has acquired. The card is updated at each activity by the Member where points are available.
• A monthly statement showing the Member’s accumulated points is emailed to the Member by Resimax Group Investor.

11. Replacement Membership Card

• Where a Member’s VIP Membership Card is lost or damaged, the Member should contact the office of Resimax Group Investor and request a replacement card.
• A replacement card will be issued at cost and the Member will be advised of the cost and the procedure for payment when the request is made.

12. Obligations of Members

A Member must not:

• act in any way that breaches these terms and conditions;
• abuse or misuse the VIP Membership program;
• supply or attempt to supply false or misleading information or make a false representation to or concerning Resimax Group Investor;
• sell, assign, or transfer, or offer to sell, assign or transfer the Member’s VIP Membership or any Benefit under the VIP Membership program.

13. Breach of Trust and Expulsion

Resimax Group offers its VIP Membership program to Members in good faith and expects that its Members will abide by the spirit and letter of its rules, including these Terms and Conditions.
Where a Member engages in unauthorised activity in respect to canvassing others to attend Resimax Group events for payment or reward over and above the legitimate accumulation of Membership points, as described here, Resimax Group will immediately:
• Cancel any points accrued in that person’s VIP Membership account, and
• Cancel that person’s VIP Membership permanently.
Unauthorised activity by a Member includes using social media or any other form for media to solicit for payment, persons to attend or participate in Resimax Group events, including Property Power events and Melbourne Property Tours.
Resimax Group shall in its sole discretion, determine whether a Member has breached these rules and should be expelled from all Membership benefits.

14. Privacy

Resimax Group Investor agrees to use any Personal Information collected in accordance with the Resimax Group Privacy Policy.

The types of personal information collected and held includes name, address, date of birth, age, language preference and nationality, contact details like phone numbers and email addresses, as well as electronic information from the Member’s use of our website. Resimax Group Investor may send electronic communications to the Member regarding third party offers, products and services available as part of the VIP Membership program. Members can unsubscribe from such electronic communications by using the unsubscribe functionality in these communications

15. Rights Pertaining to VIP Membership

The Member acknowledges that Resimax Group Investor reserves the right (in its absolute discretion) to:

• refuse to accept any person becoming a Member;
• exclude or withdraw a Member from the VIP Membership program;
• refuse to honour any Benefit accumulated by a Member;
• reverse any Benefit accumulated by a Member;
• suspend a Member’s participation in the VIP Membership program; or
• terminate a Member’s participation in the VIP Membership program.

16. Variations

Resimax Group Investor reserves the rights (at its absolute discretion) at any time to cancel, substitute or vary any of the terms and conditions of the VIP Membership program (in whole or part).

Resimax Group Investor will endeavour to give Members notice of any cancellation, substitution or variation to the VIP Membership program under this condition by either email, mail or SMS.

Benefits accumulated by Members prior to the cancellation, substitution or variation of the VIP Membership program may still be honoured at Resimax Group Investor’s absolute discretion.

17. Liability

To the maximum extent permitted by law, Resimax Group Investor is not liable for any cost, loss or damage incurred in connection with:

• any withdrawal, cancellation, variation or change to these terms and conditions;
• any breach of these terms and conditions by any person other than Resimax Group Investor; or
• providing, or not providing, any Benefit.

Resimax Group Investor’s decisions on all matters relating to the VIP membership program, including any dispute as to the identity of the Member or Guest or entitlement to any Benefit is final and binding.

18. Tax

Any tax, liability or duty in relation to any Benefit provided to a Member will be the sole responsibility of the Member. The Member should contact their accountant or taxation advisor if they have any queries relation to the tax implications of the VIP Membership program.

19. Governing Law

These terms and conditions are governed by the laws of Victoria. Any person relying on, or seeking to enforce, these terms and conditions submits to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.

20. Severability

If any provision of these terms and conditions is unenforceable or invalid, it must be read down so as to be enforceable and valid. If this is not possible, the provision may be severed without affecting the enforceability or validity of the remaining provisions

21. Waiver

Any failure or delay by Resimax Group Investor in exercising its rights under these terms and conditions does not constitute a waiver. Any wavier by Resimax Group Investor must be in writing and signed by an authorised officer of Resimax Group Investor.
